Thank you for visiting Amber’s Care! This website is owned and operated by Amber’s Care. These Terms (“Terms and Conditions”) set forth the terms and conditions under which you may use our website and services as offered by us. This website allows you to interact with other users through its online community, read menstrual health-related blogs, create your own forum posts, comment on other users forum posts, and purchase Amber’s Care Period Box. You may have your own account if you are a paying subscriber and/or if you have signed up to be a site member. In both cases, having an account allows you to see certain personal information. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.


For the purpose of these Terms and Conditions, users refers to anyone who uses this website and/or Amber’s Care services, and services refers to any of the services you can access through this website (e.g the blog, the forum page, the subscription box, or any other service on this website). 


Requirements To Use Our Website 


In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.


Purchasing Products 

When buying an item, you agree that: (i) you are responsible for reading the description of Amber’s Care Period Box before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase Amber’s Care Period Box when you commit to buy the subscription box and you complete the check-out payment process.


The prices we charge for our subscription box are listed on the website. We reserve the right to change our prices for Amber’s Care Period Box at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page, which can be seen during checkout.


Amber’s Care Period Box is a quarterly subscription box that ships 1 box every 3 months. Your billing is automatically renewed every 3 months. 


“The fee for Amber’s Care Period Box and any other charges you may incur in connection with your purchase of the box, such as taxes and possible transaction fees, will be charged at the time of your purchase to your payment method.


Returns and Refunds Policy 

All products from Amber’s Care Period Box are not eligible for return unless the item or items are defective. In this case the owner will send you the same product or a similar product to replace the defective one, free of charge. If you wish to cancel your subscription, you will receive 100% of your money back if you cancel the subscription within 2 days, up until midnight (PST) of the second day. If you are dissatisfied with your purchase, contact the owner within 7 days of receiving your subscription box to receive a refund. To accommodate for the cost of products, shipping, and materials, you will receive 50% of your money back. Your money will be returned to the card (credit card or debit card) that you used when you purchased the item. Amber’s Care does not do cash refunds. 


Retention of Right To Change Offering 


We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.


Warranties and Responsibility for Services and Products 


Amber’s Care values your decision to purchase from it and/or to use its other services. While Amber’s Care will take reasonable measures to make your experience with purchasing from Amber’s Care and/or using its other services satisfactory, such as responding to customer feedback regarding purchases, checking the quality of items (when possible) before shipping them to customers, monitoring comments on the website, and any other actions that Amber’s Care deems reasonable and that are commercially acceptable, satisfaction is not guaranteed. 


Intellectual Property 


The written works (blog posts and forum posts written by the owner) on this site are the exclusive property of Erin Butts. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof. You are allowed to share Amber’s Care’s blogs on social media and use quotations (small excerpts of the blog) for your social media or for your own blog post, but you are not allowed to copy and paste the owner’s material and submit it as your own work. If you have questions about intellectual property rights as it relates to these Terms, please contact the owner.


You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.


Amber’s Care may use your blog comments, forum posts, forum comments, and/or reviews of Amber’s Care Period Box for marketing. 


Right to Suspend or Cancel User Account


We may permanently or temporarily terminate or suspend your access to the services without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account at any time. In spite of anything previously stated, concerning automatically-renewed subscriptions to paid services, subscriptions will be discontinued only after the subscription period you already paid for has expired. 




You agree to indemnify and hold Amber’s Care harmless from any demands, loss, liability, claims or expenses (including reasonable attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website. 


Limitation of Liability 


 To the maximum extent permitted by applicable law, Amber’s Care assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein. By accepting these Terms you agree to seek advice from a medical professional if you have ongoing health conditions before trying certain products such as teas, vitamins, supplements, or any other products of this nature. If you have any problems with your subscription box, please contact the owner. See the Returns and Refunds Policy section on this page for more information regarding purchases.


Right to Change and Modify Terms


We may update these Terms from time to time. Therefore, you should review this page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made. We will let you know via email and/or a prominent notice on our service prior to the change becoming effective, and update the "Last updated" date at the top of this page. Changes to these Terms are effective when they are posted on this page. Your continued use of the website or our services after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these Terms or any future version of the Terms, do not use or access (or continue to access) the website or the services.


Promotional Emails and Content 


You agree to receive from time to time promotional messages and materials from us by mail or email. These promotional messages and materials will be sent to you if you have subscribed to Amber’s Care’s email list and/or if you have purchased Amber’s Care Period Box. If you don't want to receive these promotional materials or notices please notify us at any time. 


Preference of Law and Dispute Resolutions


These Terms, the rights and remedies provided for under the terms of this document, and any and all claims and disputes related to the terms of this document and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United States of America / California, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Fontana. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.


User Communities and Profiles 


If you have signed up to be a site member, you have a public profile that other site members and users can see, and your public activity (e.g commenting on blog posts, creating your own posts on the forum, and commenting on forum posts) can be seen by both site members and other users. You have the ability to discontinue being a site member, in which doing so will mean that other site members and users will no longer see your public profile. If you would like to discontinue being a site member, please contact the owner. Please note that discontinuing being a site member means that you will no longer be able to comment on blog posts, create your own posts on the forum or comment on forum posts.
